Last Updated: 22 April 2026. These Terms govern your access to and use of the Cryptiva platform and software wallet operated by DIRE MONEY TRANSMITTER LLC.
Please read these Terms of Use carefully before accessing or using the Cryptiva platform. By creating an account or accessing any portion of the platform, you agree to be bound by these Terms. If you do not agree, do not access or use the platform.
These Terms of Use constitute a legally binding agreement between you and DIRE MONEY TRANSMITTER LLC ("Company," "we," "us," or "our") governing your use of the Cryptiva platform, including the website at cryptiva.co.com and the Cryptiva software wallet (collectively, the "Platform").
To use the Platform, you must be at least 18 years of age, be a resident of a US state where our services are available, have the legal capacity to enter into a binding agreement, and complete identity verification as required by our KYC procedures. The Platform is not available in all US states. You are responsible for determining whether services are available in your jurisdiction before opening an account.
Creating an account requires you to provide accurate, complete, and current information. You must submit to identity verification as required by our AML/KYC program. Providing false, misleading, or incomplete information during registration or verification is a violation of these Terms and may result in immediate account termination and reporting to applicable authorities.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@cryptiva.co.com if you become aware of any unauthorized access to your account. We are not liable for losses resulting from unauthorized access caused by your failure to maintain credential security.
Accounts are personal and may not be transferred, sold, or used by or on behalf of any person other than the verified account holder. Operating an account on behalf of an undisclosed third party is prohibited.
The Platform provides access to cryptocurrency exchange services and a software wallet for supported digital assets. Services are provided for informational and transactional purposes only. Nothing on the Platform constitutes investment advice, financial advice, trading advice, or any other form of professional advice. You are solely responsible for your trading decisions.
Cryptocurrency involves substantial risk of loss. The value of digital assets can decrease significantly and rapidly. Past performance is not indicative of future results. Digital assets held through the Platform are not FDIC insured and are not bank guaranteed. You acknowledge and accept these risks as a condition of using the Platform.
Service availability may change without notice. We reserve the right to modify, suspend, or discontinue any portion of the Platform at any time. We are not liable for any loss or inconvenience resulting from service interruptions.
Applicable fees are disclosed before you confirm any transaction. By confirming a transaction, you authorize the deduction of disclosed fees. Fee schedules are subject to change with reasonable notice. Continued use of the Platform after fee schedule changes constitutes acceptance of the updated fees.
All transactions are final upon confirmation unless applicable law provides a right of cancellation. You may have cancellation rights under applicable state money transmission laws. Information about cancellation rights is provided at the time of transaction and in the Legal and Compliance section of the Platform.
You are responsible for any taxes applicable to your transactions. The Company does not provide tax advice and does not withhold taxes on your behalf except as required by law.
You agree not to use the Platform for any of the following:
All content on the Platform, including text, graphics, logos, interface design, and software, is the property of DIRE MONEY TRANSMITTER LLC or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal account management purposes. This license does not include the right to reproduce, distribute, modify, or create derivative works from any Platform content.
To the maximum extent permitted by applicable law, DIRE MONEY TRANSMITTER LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses resulting from cryptocurrency price changes, transaction failures, security incidents, or service interruptions.
Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the fees paid by you to the Company in the 90 days preceding the claim. Some states do not permit limitation of liability for certain types of damages, so this limitation may not apply to you in full.
You agree to indemnify, defend, and hold harmless DIRE MONEY TRANSMITTER LLC and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the Platform, your violation of these Terms, or your violation of any applicable law or third-party right.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved in the state or federal courts located in Tarrant County, Texas. You consent to the personal jurisdiction of these courts.
Nothing in these Terms prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or by email. The "Last Updated" date reflects the most recent revision. Continued use of the Platform after notice of changes constitutes acceptance of the revised Terms. If you do not agree to revised Terms, you must discontinue use of the Platform and contact us to close your account.
